On Monday, January 23, 2023, the Supreme Court of Tennessee entered an order dissolving the temporary suspension of Nashville attorney Dana L. Nero thereby reinstating Nero to the practice of law.

The case, titled In Re: Dana L. Nero, was brought by The Board of Professional Responsibility under Case #M2022-01412-SC-BAR-BP.

On October 7, 2022, the Court entered its Order placing Nero on temporary suspension, effective November 6, 2022, for failure to respond to the Board concerning a complaint of misconduct. Nero then filed a petition for dissolution of the October 2022 suspension order claiming that she has provided the documents requested by the Board.

The filing states:

“On January 17, 2023, the Board filed a response to the petition acknowledging that Ms.Nero provided responses on November 21, 2022, “which Disciplinary Counsel has reviewed and deems responsive to the previous requests.” Nevertheless, the Board argues that Ms. Nero has failed to demonstrate good cause for reinstatement because her petition does not establish any good faith factual basis for her initial failure to respond in a timely manner or to seek an extension of time to respond prior to her suspension.”

According to the Board, Nero’s petition should be set for an immediate hearing before a board panel for Nero to demonstrate good cause for the dissolution of the October 7, 2022 order of temporary suspension. However, the Court determined that a hearing is not necessary because the Board had admitted that the reason for Nero’s temporary suspension had been resolved.

In view of the foregoing facts and discussion, the Court ruled in favor of Nero’s petition and thereby reinstated Nero to the practice of law.
