On Friday, September 16, 2022, the Supreme Court of the State of New Mexico ruled on Respondent Albuquerque Attorney Robert M. Fiser’s Application for Leave to Resign.
The case titled In the Matter of Robert M. Fiser was brought by the Assistant Disciplinary Counsel, case no. 2022-07-4523.
On July 11, 2022, Respondent entered into a plea agreement concerning the criminal charges filed against him in the United States District Court for the District of New Mexico, Cr. No. 19-2848 JB for violation of 18 U.S.C. § 371 (Conspiracy) and 26 U.S.C. § 7206(2) (Aiding and Assisting in Preparation of a False and Fraudulent Return, Statement, or Other Document).
The Assistant Disciplinary Counsel, upon recommendation by the Disciplinary Board, petitioned the Court to summarily suspend Respondent from the practice of law on July 25, 2022, which the Court granted by Order dated August 18, 2022.
On August 19, 2022, Respondent, through his attorney Jason Bowles, filed his Affidavit coupled with his Unopposed Application for Leave to Resign requesting that he be allowed to resign from the membership in the State Bar of New Mexico.
The Disciplinary Counsel, pursuant to the Court’s order requesting a response to Respondent’s application, responded and concurred with the application.
Accordingly, the Supreme Court of New Mexico granted Respondent’s unopposed application.
The Order reads:
“IT IS FURTHER ORDERED that respondent, ROBERT M. FISER, is WITHDRAWN from membership in the State Bar of New Mexico effective immediately and subject to the following terms and conditions:
- Respondent’s resignation is permanent pursuant to Rule 17-209(E) NMRA.
- Respondent accepted a plea agreement in United States of America v. Robert Fiser, CR No. 19-2848 JB (D.N.M. 2022), wherein REspondent pled guilty to two counts of Conspiracy and Aiding and Assisting in Preparation of a False and Fraudulent Return, Statement, or Other Document.
- Respondent will arrange for another CPA finish and sign any pending 2021 tax returns for Respondent’s clients, and Respondent will notify his clients that they must seek a substitute CPA for any 2022 tax returns.
- Respondent consents to the Supreme Court of the State of New Mexico requiring reasonable conditions for protection of the public, including making a permanent record of Respondent’s resignation under Rule 17-209(E) NMRA.
IT IS FURTHER ORDERED that Respondent’s unopposed application for leave to resign and this order disposing of this proceeding are matters of public record and subject to publication.”
As of today, Mr. Robert M. Fiser limited his practice to tax & business consulting, property transactions, estates & trusts. He graduated from the University of New Mexico School of Law.
