On Tuesday, November 26, 2024, the New York Supreme Court, Appellate Division, First Judicial Department denied Timothy J. McIlwain’s motion for reinstatement. McIlwain had sought to regain his status as an attorney and counselor-at-law in New York following a suspension due to a disciplinary action from New Jersey.
The case is entitled “In the Matter of Timothy J. McIlwain,” with case no. 2023-06177.
McIlwain faced a one-month suspension effective June 24, 2024, as a consequence of an order issued by the Supreme Court of New Jersey on July 20, 2023. In his recent motion, McIlwain, representing himself, requested the court to reinstate him.
However, the court noted that McIlwain failed to provide an affidavit of compliance, a requirement under 22 NYCRR 1240.15(f). The Attorney Grievance Committee, represented by Chief Attorney Jorge Dopico and counsel Christopher S. Ronk, submitted an affirmation opposing McIlwain’s motion, reinforcing the necessity of compliance with procedural rules.
After reviewing the relevant documents and considering the arguments presented, the court unanimously decided to deny McIlwain’s motion without prejudice, allowing him the opportunity to renew his request once he fulfilled the requirements. As a result, McIlwain remains suspended from practicing law in New York.
According to avvo.com, Mr. Mcllwain is a personal injury attorney in Northfield, New Jersey. He acquired his law license in New York in 2019.
