On Thursday, July 13, 2023, the State of New York Supreme Court, Appellate Division Third Judicial Department granted the motion for reinstatement of attorney Bill Cogan.

The case is entitled “Attorney Grievance Committee for the Third Judicial Department v. Bill Cogan” with case no. PM-150-23.

Cogan filed a motion requesting an order for his reinstatement to the practice of law after his suspension by a May 2019 court order (referenced as Matter of Attorneys in Violation of Judiciary Law § 468-a, 172 AD3d 1706, 1717 [3d Dept 2019]). The suspension was governed by the Rules for Attorney Disciplinary Matters and the Rules of Appellate Division, 3rd Department.

After carefully reviewing Cogan’s notice of motion, affidavit, and exhibits, all sworn to on March 14, 2023, as well as the responsive correspondence from the Attorney Grievance Committee for the Third Judicial Department, dated April 19, 2023, the court has reached a decision based on clear and convincing evidence. The court found that the respondent has fulfilled the requirements outlined in the Rules of the Appellate Division, Third Department (22 NYCRR) § 806.16(c).

Furthermore, the court noted that Cogan has demonstrated compliance with the order of suspension and the rules set forth by the court. Additionally, the court was satisfied that Cogan possesses the necessary character and fitness to practice law. Taking into consideration all these factors, the court has determined that reinstating the same to the practice of law would be in the public interest, in accordance with the Rules for Attorney Disciplinary Matters.

As a result, the court granted Cogan’s motion for reinstatement. This decision allows Cogan to resume practicing law, having met the stipulated requirements and proving suitability for reinstatement.

The order states:

“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
