On Thursday, July 3, 2025, the New York Supreme Court, Appellate Division, Third Judicial Department granted Attorney Thomas Joseph Tierney’s application to resign from the New York Bar for nondisciplinary reasons. The decision, effective immediately, removes Tierney’s name from the state’s roll of attorneys and counselors-at-law.
The case is entitled “In the Matter of Thomas Joseph Tierney,” with case no. PM-149-25.
Tierney swore an affidavit on May 13, 2025, requesting to resign voluntarily, and the application was filed two days later on May 15, 2025. The Attorney Grievance Committee for the Third Judicial Department reviewed the request and raised no objections.
The court determined that Tierney met the eligibility criteria for nondisciplinary resignation under the Rules for Attorney Disciplinary Matters. As part of the court’s order, Tierney is prohibited from practicing law in New York in any capacity, including as a principal, agent, clerk, or employee. He is also barred from appearing as an attorney before any court, judge, justice, board, commission, or other public authority in the state.
Additionally, Tierney is forbidden from providing legal opinions or advice or presenting himself as an attorney in New York. The court further mandated that Tierney surrender any Attorney Secure Pass issued to him to the Office of Court Administration within 30 days of the decision.
The Disposition states:
“It is ORDERED that Thomas Joseph Tierney’s application for permission to resign is granted and his nondisciplinary resignation is accepted.”
According to Avvo.com, Mr. Tiernay is an employment and labor attorney in Norwalk, Connecticut. He acquired his law license in New York in 1993.
