On Wednesday, September 11, 2024, the Supreme Court of the State of New York, Appellate Division, Second Judicial Department issued an opinion and order disbarring attorney David Thomas Schlendorf from practicing law.
The case is entitled “In the Matter of David Thomas Schlendorf,” with case no. 2023-08466.
The court’s decision came after the Supreme Court of New Jersey disbarred Mr. Schlendorf by consent in December 2022 due to allegations of knowingly misappropriating client funds. Mr. Schlendorf acknowledged that the allegations against him were true and that he could not successfully defend himself if the matter went to a hearing.
As a result, the New York court found reciprocal discipline was warranted. The justices noted that in New York, an attorney who resigns while under investigation generally receives disbarment. Therefore, the court officially disbarred Mr. Schlendorf and struck his name from the roll of attorneys.
The Disposition states:
“ORDERED that pursuant to 22 NY CRR 1240.13, the respondent, David Thomas Schlendorf is disbarred, effective immediately, and his name is stricken from the roll of attorneys and counselors-at-law.”
According to avvo.com, Mr. Schlendorf was a criminal defense attorney in Toms River, New Jersey. He attended the St John’s University School of Law, graduating in 1996. He acquired his law license in New York in 1997.
