On Thursday, June 5, 2025, the New York Supreme Court, Appellate Division, First Judicial Department disbarred attorney John Spencer Jenkins, striking his name from the roll of attorneys in the State of New York, effective immediately. The decision follows Jenkins’ failure to respond to disciplinary proceedings initiated by the Attorney Grievance Committee (AGC) for the First Judicial Department.
The case is entitled “In the Matter of John Spencer Jenkins,” with case no. 2024-02309.
Jenkins was previously suspended from practicing law on August 22, 2024. The suspension stemmed from his failure to address a complaint as directed by the AGC and a prior suspension in Florida for allegations including conversion or misappropriation of client funds.
The AGC sought Jenkins’ disbarment under court rules allowing for such action when a suspended attorney fails to engage in investigatory or disciplinary proceedings within six months of suspension. The committee served the disbarment motion using substitute service, as authorized by a court order on April 10, 2024, due to difficulties in reaching Jenkins directly. Jenkins did not submit a response to the motion.
The court’s order prohibits Jenkins from practicing law in any capacity, including acting as an attorney, providing legal advice, or presenting himself as a lawyer. He is also required to comply with rules governing disbarred attorneys and return any secure pass issued by the Office of Court Administration.
The Disposition states:
“Wherefore, it is Ordered that the motion by the Attorney Grievance Committee for the First Judicial Department for an order pursuant to 22 NYCRR 1240.9(b), disbarring respondent John Spencer Jenkins is granted, and the respondent is disbarred and his name stricken from the roll of attorneys in the State of New York, effective immediately, and until further order of this Court.”
According to Avvo.com, Mr. Jenkins is a litigation attorney in Fort Lauderdale, Florida. He acquired his law license in New York in 2007.
