On Thursday, July 25, 2024, the New York Supreme Court, Appellate Division, Third Judicial Department granted attorney Gareth William Notis’ motion for reinstatement and accepted his resignation for nondisciplinary reasons.
The case is entitled “In the Matter of Gareth William Notis,” with case no. PM-143-24.
Notis had been suspended from practice in September 2009. In his motion sworn on May 2024, Notis provided affidavits and documentation showing he had complied with the terms of his suspension and demonstrating he possesses the requisite character and fitness to once again practice law.
The Attorney Grievance Committee for the Third Judicial Department, which investigates ethical misconduct by attorneys, responded to Notis’ motions but did not oppose his reinstatement or resignation.
In granting the motion, the New York Court found clear and convincing evidence that Notis met the standard under Section 1240.16(a) of the Rules for Attorney Disciplinary Matters for being reinstated. The court also accepted his his nondisciplinary resignation.
Notis has been removed from the roll of eligible attorneys. He also must surrender any Attorney Secure Pass issued to him within 30 days.
The Disposition states:
“ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately; and it is further ORDERED that respondent’s application for leave to resign is simultaneously granted and his nondisciplinary resignation is accepted.”
According to martindale.com, Mr. Notis acquired his law license in New York in 1999.
