On Thursday, June 8, 2023, the State of New York Supreme Court, Appellate DivisionThird Judicial Department reinstated attorney Maria Veronica Yepez from the practice of law.

The case is entitled “Attorney Grievance Committee for the Third Judicial Department v. Maria Veronica Yepez” with case no. PM-122-23

In a significant legal development, a motion filed by an attorney seeking reinstatement to the practice of law has been granted by the State of New York court. The attorney had been previously suspended by a court order in September 2022, as a consequence of the Matter of Attorneys in Violation of Judiciary Law § 468-a. The court’s decision was influenced by the Rules for Attorney Disciplinary Matters [22 NYCRR] § 1240.16 and the Rules of the Appellate Division, Third Department [22 NYCRR] § 806.16.

After a careful examination of the respondent’s notice of motion, along with the accompanying affidavit and exhibits sworn to on February 15, 2023, as well as the responsive correspondence received from the Attorney Grievance Committee for the Third Judicial Department on March 23, 2023, the court concluded, based on clear and convincing evidence, that the respondent had fulfilled the requirements of the suspension order and the court’s rules. Moreover, the respondent was found to possess the necessary character and fitness to continue practicing law. Considering the public interest, the court granted the respondent’s motion for reinstatement, effectively restoring her status as an attorney and counselor-at-law with immediate effect. This decision brings relief to the respondent and marks a significant step forward in her professional career.

The Disposition states:

“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
