On Thursday, July 27, 2023, the State of New York Supreme Court, Appellate Division Third Judicial Department reinstated attorney James R. Grimes III.
The case is entitled “In the matter of James R. Grimes III,” with case no. PM156-23.
Grimes has filed a motion seeking reinstatement to the practice of law after being suspended by a court order in September 2022. The suspension was imposed as a result of violating Judiciary Law § 468-a. The specific case reference for the suspension is “Matter of Attorneys in Violation of Judiciary Law § 468-a, 208 AD3d 1421, 1431 [3d Dept 2022].” The motion for reinstatement is subject to the relevant rules and regulations governing attorney disciplinary matters, specifically, Rules for Attorney Disciplinary Matters.
After thoroughly reviewing Grimes’s notice of motion, along with the affidavit and exhibits sworn to on April 10, 2023, as well as the responsive correspondence from the Attorney Grievance Committee for the Third Judicial Department dated May 12, 2023, and upon careful consideration of clear and convincing evidence, the court has reached the following conclusions: Firstly, Grimes has demonstrated compliance with the order of suspension and has adhered to the rules set forth by this Court. Secondly, Grimes has exhibited the necessary character and fitness required to practice law. Lastly, the reinstatement of the same to the practice of law is deemed to be in the public interest, as stipulated under “Rules for Attorney Disciplinary Matters [22 NYCRR] § 1240.16 [a].”
Consequently, the court granted the respondent’s motion for reinstatement, effective immediately, restoring the respondent’s status as an attorney and counselor-at-law.
The Disposition states:
“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
