On Thursday, December 15, 2022, the New York Supreme Court, Appellate Division ruled on the motion for reinstatement filed by Michigan attorney James Joseph Sarconi.
The original case, titled In the Matter of Attorneys in Violation of Judiciary Law § 468-a, was brought by the Attorney Grievance Committee for the Third Judicial Department, with case no. PM-227-22.
Mr. Sarconi is among the attorneys that were suspended from the practice of law by the Court by an Order dated September 1, 2022, after findings of uncontroverted evidence of misconduct in the form of documentary proof that each respondent failed to fulfill his or her attorney registration obligations and their delinquency in fulfilling said obligation.

Mr. Sarconi filed a motion praying that he be reinstated to the practice of law.
The Order granted Mr. Sarconi’s motion and was reinstated as an attorney and counselor-at-law.
The Order states:
‘Upon reading respondent’s notice of motion and affidavit with exhibits sworn to September 19, 2022, and the October 24, 2022, responsive correspondence from the Attorney Grievance Committee for the Third Judicial Department, and having determined, by clear and convincing evidence, that (1) respondent has complied with the order of suspension and the Rules of this Court, (2) respondent has the requisite character and fitness to practice law, and (3) it would be in the public interest to reinstate respondent to the practice of law.’
The Disposition states:
“It is ORDERED that respondent’s motion for reinstatement is granted; and it is further
ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
As of today, Mr. Sarconi is listed as a Shareholder at O’Reilly Rancilio P.C. serving Southeast Michigan. He graduated from the Ohio State University Moritz College of Law in 2003. He is licensed in New York, license #5276902, as well as in Michigan.
