On Thursday, July 27, 2023, the State of New York Supreme Court, Appellate Division Third Judicial Department reinstated attorney Jason Charles Reis.

The case is entitled “In the matter of Jason Charles Reis.” with case no. PM157-23.

Reis filed a motion seeking reinstatement to the practice of law after being suspended by a court order in September 2009. The suspension was a result of violating Judiciary Law § 468-a, as referenced in the case “Matter of Attorneys in Violation of Judiciary Law § 468-a, 65 AD3d 1447, 1473 [3d Dept 2009].” The motion for reinstatement is subject to the applicable rules and regulations governing attorney disciplinary matters, specifically, “Rules for Attorney Disciplinary Matters [22 NYCRR] § 1240.16” and “Rules of App Div, 3d Dept [22 NYCRR] § 806.16.”

Upon reviewing Reis’ notice of motion and affidavit with exhibits sworn to on April 11, 2023, and considering the responsive correspondence from the petitioner for the Third Judicial Department dated May 18, 2023, the court has reached the following conclusions by clear and convincing evidence:

  1. Reis has fulfilled the requirements outlined in Rules of the Appellate Division, Third Department (22 NYCRR) § 806.16 (c).
  2. Reis has complied with the order of suspension and adhered to the rules set forth by the court.
  3. Reis possesses the necessary character and fitness essential for the practice of law.
  4. Reinstating Reis to the practice of law aligns with the public interest, as stipulated under “Rules for Attorney Disciplinary Matters [22 NYCRR] § 1240.16 [a].”

Based on these findings, the court granted Reis’ motion for reinstatement as an attorney and counselor-at-law, with immediate effect.

The Disposition states:

“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
