On Wednesday, September 10, 2025, the New Jersey Supreme Court suspended attorney Gilberto M. Garcia from practicing law for six months, effective October 10, 2025.
The case is entitled “In the Matter of Gilberto M. Garcia,” with case number 090756.
The suspension stems from a decision by the Disciplinary Review Board (DRB 24-281), which found Garcia in violation of multiple Rules of Professional Conduct (RPC).
According to the DRB’s findings, Garcia violated RPC 3.3(a)(1) by knowingly making false statements of material fact to a tribunal on two occasions. He also violated RPC 8.1(a) by making false statements of material fact to disciplinary authorities in two instances. Furthermore, Garcia was found to have engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation, violating RPC 8.4(c) twice, and engaged in conduct prejudicial to the administration of justice, violating RPC 8.4(d) twice.
The Supreme Court’s order mandates that Garcia comply with Rule 1:20-20, which pertains to suspended attorneys. The order also stipulates that failure to comply with the Affidavit of Compliance requirement of Rule 1:20-20(b)(15) may lead to several consequences. These include preclusion from the Disciplinary Review Board considering Garcia’s petition for reinstatement for up to six months from the date he files proof of compliance, a finding of violation of RPC 8.1(b) and RPC 8.4(d), and potential action for contempt pursuant to Rule 1:10-2.
The Supreme Court has ordered that the entire record of the matter be permanently included in Garcia’s file as an attorney at law of the State. Additionally, Garcia is required to reimburse the Disciplinary Oversight Committee for appropriate administrative costs and actual expenses incurred during the prosecution of the case.
