On Monday, August 29, 2022, the Supreme Court of Iowa issued an Order of Suspension against Iowa City attorney Randy Ernest Trca for charges of non-compliance with the Client Security Commission’s request for information regarding a pending claim.
The case, titled In the Matter Randy E. Trca, was brought by the Client Security Commission with case number #22-1376.
Iowa Court Rule 39.10(3) provides:
Each member of the bar of Iowa must do all of the following:
a. Cooperate fully with the executive director in any investigation, audit, or verification of any funds, securities, or property held in trust by that lawyer.
b. Answer all questions posed by the executive director that relate to any investigation, audit, or verification, unless claiming the privilege against self-incrimination.
c. Retain complete records of all trust fund transactions for a period of not less than six years following completion of the matter to which they relate, in accordance with Iowa Rule of Professional Conduct 32:1.15 and Iowa Court Rule 45.2(3).
According to the filing:
On July 1, 2022, the Commission notified Trca of a pending claim against the Clients’ Security Trust Fund arising from his actions as an Iowa lawyer and requested his response. Trca failed to respond regarding the claim. On July 20, 2022, the Commission notified Trca that his license to practice law would be suspended unless he cured the delinquency or filed in the office of the supreme court clerk a request for a hearing to show cause why his license to practice should not be suspended.
The Commission has certified that the fifteen-day notice period of Iowa Court Rule 39.8(2) has elapsed and states that Trca has not provided the information the Commission has requested regarding the claim, nor has he filed a request for a hearing.
The court concludes that the license of Randy E. Trca to practice law in Iowa should be temporarily suspended.
