On Wednesday, October 11, 2023, the Florida Bar filed a petition for contempt and order to show cause against attorney Joanne Marie Prescott for allegedly violating the terms of her probation.

The case is entitled “The Florida Bar v. Joanne Marie Prescott,”

On September 15, 2022, Prescott was placed on probation for three years after receiving a public reprimand for her actions. The terms of her probation also required her to contact Florida Lawyers Assistance, Inc. (FLA, Inc.) within 30 days for an evaluation and to comply with a three-year contract with FLA, Inc. for rehabilitation.

The Florida Bar has requested that Prescott provide a signed copy of her contract with FLA, Inc. by September 30, 2022, and has notified her that failure to pay the monthly monitoring fees to FLA, Inc. will be reported to The Florida Bar and may result in contempt proceedings. The bar has also warned Prescott that failure to comply with the terms of her probation may result in a lapse of her membership status and require her to reapply to the Florida Board of Bar Examiners to return to the practice of law.

However, despite the warnings, the Florida Bar states that Prescott violated the terms of her probation. The former filed a petition for contempt and an order to show cause against the latter. The bar is also requesting that the probationary period in Supreme Court Case No. SC2022-0811 be terminated and Prescott undergoes a substance abuse evaluation by an approved FLA, Inc. provider and complies with the evaluation recommendations before seeking reinstatement.

The request states:

“The bar respectfully requests this Court enter an order directing respondent, Joanne Marie Prescott, to show cause why she should not be held in contempt and be suspended for 91 -days and assessed costs in the amount of $1,250.00 to The Florida Bar.”

According to avvo.com, Ms. Prescott is an admiralty and maritime attorney in Orlando, Florida. She graduated from the University of Florida’s Fredric G. Levin College of Law in 1996 and obtained her law license in Florida the same year.
