On Thursday, August 31, 2023, the Supreme Court of Florida suspended attorney Mark Edwin Heimendinger from practicing law due to a guilty judgment.

The case is entitled “The Florida Bar v. Mark Edwin Heimendinger,” with case no. SC2023-1224.

On August 29, 2023, the Florida Bar filed a Notice of Determination or Judgment of Guilt against Heimendinger due to his criminal charges and conviction. Heimendinger entered a plea of nolo contendere to Aggravated Assault, carrying a concealed firearm, improper exhibition of a dangerous weapon, and battery. The court withheld adjudication on the two felony charges and adjudicated him guilty on the two misdemeanor charges, sentencing him to 60 months of conditional probation and two days imprisonment.

The Florida Bar requested the Supreme Court of Florida to enter an order finding Heimendinger guilty of violating Rule 4-8.4(b) of the Rules Regulating The Florida Bar, suspending him pursuant to Rule 3-7.2(f), and appointing or directing the appointment of a referee to conduct a hearing on sanctions pursuant to Rule 3-7.2(h). The Florida Bar also requests that Heimendinger furnish a copy of the suspension order to all clients, opposing counsel, and courts before which he is counsel of record as required by Rule 3-5.1(h) of the Rules of Discipline of The Florida Bar.

In light of the notice of determination of judgment of guilt, the Supreme Court of Florida decided to suspend Heimendinger. The suspension will be effective 30 days from the date of the order, allowing Heimendinger time to close out his practice and protect his existing clients’ interests.

The Disposition states:

“The Florida Bar having filed on August 29, 2023, Notice of Determination or Judgment of Guilt, it is ordered that Mark Edwin Heimendinger is suspended from The Florida Bar pursuant to 3- 7.2(t) of the Rules Regulating The Florida Bar.”

According to avvo.com, Mr. Heimendinger is a real state attorney in Oviedo, Florida. He attended the Emory University School of Law, graduating in 2001. He acquired his law license in Florida in 2016.
