On Wednesday, August 16, 2023, the Supreme Court of Pennsylvania imposed a suspension on attorney Daniel D. Hediger from practicing law in Pennsylvania, in response to disciplinary actions taken by the Supreme Court of New Jersey.
The case is entitled “In the MatterDaniel D. Hediger,” with case no. 97 DB 2023.
As per the determination made by the Disciplinary Review Board in New Jersey, Hediger was found to have violated RPC 1.15(d) (for not adhering to the recordkeeping stipulations outlined in Rule 1:21-6) and RPC 8.1(b) (for failing to cooperate with disciplinary authorities).
Consequently, this led to Hediger’s suspension from the practice of law, in the State of New Jersey which began on June 12, 2023. However, the suspension was accompanied by an opportunity for reinstatement. The DRB mandated that prior to returning to legal practice in New Jersey, Hediger had to ensure that his ATA (Attorney Trust Account) and ABA (Attorney Business Account) were fully compliant with the recordkeeping regulations. The compliance of these accounts was subject to review and confirmation by the Office of Attorney Ethics. Furthermore, Hediger was required to adhere to Rule 1:20-20, which specifically addressed the obligations of suspended attorneys. A crucial component of this rule involved the affidavit of compliance requirement, a failure of which might have delayed Hediger’s reinstatement petition for up to six months from the date of compliance proof submission.
Following Hediger’s discipline in the State of New Jersey, an order by the Supreme Court of Pennsylvania indicated that Hediger did not challenge the imposition of reciprocal discipline.
The Disposition states:
“Hediger is suspended from the practice of law in the Commonwealth of Pennsylvania for a period of three months, subject to satisfaction of the condition imposed by the Order of the Supreme Court of New Jersey filed May 10, 2023.”
