On Thursday, February 2, 2023, the State of New York, Supreme Court, Appellate Division, Third Judicial Department, accepted attorney Elkanah J. Burns’s petition to resign for non-disciplinary reasons.

The case is entitled “In the matter of Elkanah J. Burns Jr.” with case no. PM-15-23.

On November 18, 2022, the petitioner filed a sworn affidavit in relation to his purpose of seeking leave to resign from the New York bar for non-disciplinary reasons. The Attorney Grievance Committee (ACG) for the third judicial department didn’t oppose the petition submitted by the respondent.

In consideration of the sworn affidavit of Mr. Burns, and with the advice as stated by the ACG wherein it declared the eligibility of Mr. Burns to resign for non-disciplinary reasons, the court granted the said application and thereby his resignation.

The petitioner is ordered to be stricken from the roll of attorneys and counselors at law of the State of New York. Moreover, the petitioner was mandated to desist and refrain from the practice of law in any form in the State of New York, whether as an agent, principal, employee, or clerk. He is forbidden to appear as an attorney or counselor at law before any judge, court, justice, board, commission, or public authority. The petitioner must also refrain from giving his opinion as to the law and application, or any advice in relation as well.

The Disposition states:

“ORDERED that Elkanah J. Burns Jr.’s application for permission to resign is granted and his nondisciplinary resignation is accepted.
