On Monday, July 31, 2023, the Board of Disciplinary Appeals in Texas publicly reprimanded attorney Rumit Ranjit Kanakia for violating the specific provisions of the United States Patent and Trademark Office (USPTO) Rules of Professional Conduct.

The case is entitled “In the Matter of Rumit Ranjit Kanakia,” and was brought by the Commission for Lawyer Discipline with case no. 68045.

In a petition for reciprocal discipline filed on July 13, 2023, it was indicated that the Commission for Lawyer Discipline submitted a request for reciprocal discipline against Rumit Ranjit Kanakia. This request was grounded in a final order issued by the USPTO on May 8, 2023. The USPTO determined that Kanakia had violated specific provisions within the USPTO Rules of Professional Conduct, notably involving improper claims of micro entity status and failing to notify the USPTO of changes in applicant status. Consequently, Kanakia has consented to receive a public reprimand along with other sanctions.

The Commission sought a parallel disciplinary action from the Board of Disciplinary Appeals in Texas and formally asked Kanakia to provide reasons for why identical discipline should not be instituted in Texas. Additionally, the Commission requested any other suitable remedies.

The petition states:

“Petitioner prays that pursuant to Rule 9.02, Texas Rules of Disciplinary Procedure, this Board issue notice to Respondent, containing a copy of this Petition with exhibits, and an order directing Respondent to show cause within thirty (30) days from the date of the mailing of the notice, why the imposition of the identical discipline in this state would be unwarranted.”

Based on the factual findings mentioned above, Kanakia and the petitioner reached an agreement that resulted in an agreed judgment of public reprimand wherein Kanakia acknowledged that, based on the information contained in the jointly stipulated facts, Kanakia’s acts and omissions violated the provisions of the USPTO Rules of Professional Conduct.

The Disposition states:

“It is, accordingly, ORDERED, ADJUDGED, AND DECREED that Respondent, Rumit Ranjit Kanakia, State Bar Card No. 24124286, is hereby PUBLICLY REPRIMANDED as an attorney at law in the State of Texas.”
