On Tuesday, November 29, 2022, the Supreme Court of Florida permanently disbarred Boca Raton attorney Brian Jay Glick after failing to file a response in the Order to Show Cause issued by the Court. The case is entitled “The Florida Bar v. Brian Jay Glick” and was brought by Florida Bar with case no. SC22-1197.
In a Petition, dated September 9, 2022, it was stated that the after a suspension of the respondent for misappropriation of trust funds and to the bar, the court in an Order, approving the Bar’s petition for emergency suspension instructed the respondent to stop disbursing or withdrawing any money from any trust account related to the Respondent’s law practice without the approval of the Florida Supreme Court or a referee appointed by the same, or by an Order of the Circuit Court in which an inventory attorney has been appointed. However, the respondent still attempted to do so.
The Petition states:
“Despite this clear prohibition, on at least eight occasions checks were presented to the bank to disburse funds from the trust account #7563 after the respondent’s emergency suspension and subsequent disciplinary revocation.”
The Florida Bar, on its petition, requested that the Court enter an order compelling the respondent to show cause why he should not be held in contempt of Court. However, failing to file a response, the respondent was disbarred in accordance with the order of the Court.
The Disposition states:
“IT IS ORDERED that The Florida Bar’s petition is granted and the respondent is held in contempt of this Court. See R. Regulating Fla. Bar 3-7.11(9(1)D). As a sanction, the respondent is permanently disbarred from the practice of law in the State of Florida, effective immediately. Respondent shall fully comply with Rule Regulating the Florida Bar 3-5.1(h). Respondent shall also fully comply with Rule Regulating the Florida Bar 3-6.1, if applicable.”
