On Thursday, August 25, 2022, the Supreme Court of Florida ruled on charges for attorney discipline against West Palm Beach attorney Erika Lynn Muller. The ruling disbars the attorney.

The case, titled The Florida Bar vs. Erika Lynn Muller, was brought by The Florida Bar. Case #SC22-221.

The charges cited Muller’s violation of Rules 4-1.1, 4-1.2(a), 4-1,3, 4-1.4(a), 4-1.4(b), 4-3.2, 4-3.3(a)(1), 4-3.4(b), 4-4.1(a) and 4-8.4(c) of the Rules Regulating the Florida Bar.

According to the Report of the Referee:

“On February 17, 2022, The Florida Bar filed its Formal Complaint against respondent in these proceedings. To this point, respondent has completely failed to participate in this disciplinary proceeding or in the staff level or grievance committee proceedings which preceded the Formal Complaint. This referee entered an Order of Default on March 15, 2022. In addition, a respondent is fees delinquent and has failed to update her record bar address.”

The complaint involves Respondent’s misconduct by engaging in a pattern of neglect and fraudulent conduct in her representation of a client.

The Referee recommended that respondent be found guilty of misconduct, and that she be disbarred and pay the costs of the proceedings.

Accordingly, the Supreme Court of Florida accepts the uncontested report of the referee. 

The Order reads:

“respondent is disbarred, effective thirty days from the date of this order so that respondent can close out her practice and protect the interests of existing clients. If respondent notifies this Court in writing that she is no longer practicing and does not need the thirty days to protect existing clients, this Court will enter an order making the disbarment effective immediately. Respondent shall fully comply with Rule Regulating the Florida Bar 3-5.1(h). Respondent shall also fully comply with Rule Regulating the Florida Bar 3-6.1, if applicable. Further, respondent shall accept no new business from the date this order is filed.”

The Court also charged to the Respondent the costs incurred by the Florida Bar amounting to $1,315.
