On Wednesday, February 12, 2025, the Supreme Court of Indiana accepted the resignation of Attorney David A. Root from the state bar. This decision came in response to a filing by the Commission, which requested Root’s interim suspension due to his felony conviction.
The case is entitled “In the Matter of David A. Root,” with case no. 25S-DI-19.
Root submitted an affidavit acknowledging that there were ongoing investigations into allegations of misconduct against him, and he recognized that he could not successfully defend himself in a potential disciplinary proceeding. As a result, the Court has ordered that his resignation be effective immediately, and the Roll of Attorneys Administrator is tasked with updating the records to reflect this change.
The Commission’s request for Root’s interim suspension has been deemed moot following his resignation. Consequently, any pending disciplinary actions against him have also been dismissed. Under the terms of the Indiana Admission and Discipline Rules, Root will be ineligible to seek reinstatement to the practice of law for a period of five years from the date of this order. If he chooses to pursue reinstatement, any admitted misconduct or additional allegations may be considered during that process.
The Disposition states:
“IT IS THEREFORE ORDERED that the resignation from the bar of this State tendered by Respondent is accepted effective immediately.”
According to avvo.com. Mr. Root was an attorney in Indianapolis, Indiana. He acquired his law license in Indiana in 2006.
