On Thursday, November 9, 2023, the Iowa Supreme Court formally accepted the public reprimand issued to Attorney Tomas Rodriguez by the Iowa Supreme Court Attorney Disciplinary Board. The order states that Rodriguez did not file any exceptions to the board’s disciplinary action within the prescribed time period.

The case is titled ‘Iowa Supreme Court Disciplinary Board v. Tomas Rodriguez’ with case nos. 2022-324 and 2023-088.

The cited misconduct involves violations of Rules 32:1.1, 32:1.3, 32:3.2, 32:3.4, and 32:8.4(d), 32:1.4, 32:3.2 of the Iowa Rules of Professional Conduct.

In early 2022, two parole judges in Scott County filed a complaint against Rodriguez with the Iowa Supreme Court Attorney Disciplinary Board. They alleged that Mr. Rodriguez had failed to appear for multiple parole revocation hearings, after being appointed to represent clients by the Scott County District Court. The parole officers stated that hearings were scheduled on Wednesday afternoons at 1:30 pm via telephone, making attendance easy. However, Attorney Rodriguez did not show up for hearings or return calls from parole officers or his clients at the jail.

Attorney Rodriguez admitted by email that he “had other stuff to worry about besides the hearings.” The Board found that his failure to appear and communicate with clients violated several rules regarding competence, diligence, fairness, and conduct prejudicial to the justice system.

In early 2023, another complainant filed a grievance regarding Attorney Rodriguez’s representation of him on charges of harassment, stalking, burglary, and violation of a no-contact order. The complainant alleged that Attorney Rodriguez failed to communicate with him, failed to show up in court, and on other occasions, would come hours late.

Considering both complaints jointly, the Board determined that Attorney Rodriguez displayed a pattern of rule violations around diligence, expediting litigation, and conduct prejudicial to the courts. As a result, on August 22, 2023, the Board issued a public reprimand against Attorney Rodriguez for his misconduct. He was notified he could file an exception within 30 days, otherwise, the reprimand would become final.

Following Rodriguez’s failure to contest the disciplinary measures imposed by the board, the Supreme Court publicly reprimanded Tomas Rodriguez and ordered that the reprimand be recorded in the court’s documents.
