On Friday, April 18, 2025, the Supreme Court of Minnesota reinstated attorney Daniel Miller to the practice of law, following a suspension that began in October 2019.

The case is entitled “In the Matter of Daniel Miller,” with case no. A24-1106.

Miller had been indefinitely suspended for professional misconduct related to probate cases and failure to cooperate with the Office of Lawyers Professional Responsibility. The 2019 suspension stemmed from issues including improper billing practices, incompetence, lack of diligence, failure to communicate with clients, and making false statements to a court and a client. Additionally, Miller failed to comply with court orders and return a client’s file, leading to a court-ordered repayment to an estate.

In July 2024, Miller applied for reinstatement, and a hearing was conducted before a panel of the Lawyers Professional Responsibility Board. The panel determined that Miller demonstrated clear and convincing evidence of a moral transformation, making him suitable to resume practicing law. They also confirmed his intellectual competency for legal practice. The panel recommended his reinstatement with a two-year probationary period, a recommendation supported by both Miller and the Director of the Office of Lawyers Professional Responsibility, who waived their procedural rights to expedite the process.

The Minnesota Supreme Court approved the reinstatement, effective once Miller pays the required registration fees to the Minnesota Lawyer Registration Office. His two-year probation will begin when he resumes active legal practice and includes several conditions. Miller must notify the Director at least 30 days before returning to practice, abide by the Minnesota Rules of Professional Conduct, and fully cooperate with the Director’s monitoring efforts. He will be supervised by a licensed Minnesota attorney appointed by the Director, with whom he must meet quarterly and provide monthly inventories of active client files.

The Disposition states:

“IT IS HEREBY ORDERED THAT: Petitioner Daniel Miller is reinstated to the practice of law, effective upon payment of the required registration fees to the Minnesota Lawyer Registration Office.”
