On Wednesday, October 4, 2023, the Supreme Court of New Jersey issued a reprimand to attorney Meryl M. Polcari for violating several rules of professional conduct. The disciplinary action was taken following a granting of a motion for discipline by consent.

The case is entitled “In the Matter of Meryl M. Polcari,” with case no. 088665.

According to the filing,  the court found that Polcari violated the following New Jersey Rules of Professional Conduct: RPC 1.15(a) (commingling), RPC 1.15(b) (failure to promptly deliver funds belonging to a client), and RPC 1.15(d) (failure to comply with the recordkeeping requirements of Rule 1:21-6).

On September 27, 2023, the Disciplinary Review Board (DRB) issued a decision on the matter of Polcari. The DRB found that Polcari had commingled funds, failed to promptly deliver funds to clients, and failed to comply with recordkeeping requirements. The DRB imposed a reprimand on Polcari, citing mitigating factors such as her lack of prior discipline and her efforts to correct the recordkeeping deficiencies that were previously brought to her attention. The Board also noted that Polcari had taken steps to resolve the deficiencies associated with her attorney trust accounts, including submitting checks to the Superior Court Trust Fund for deposit and addressing outstanding balances and unidentified funds.

The Supreme Court of New Jersey upheld the Board’s decision to issue a reprimand as the appropriate discipline for Polcari’s unethical conduct.

The entire record of the proceedings has been made a permanent part of Polcari’s file as an attorney at law of the State of New Jersey. Polcari was also ordered to reimburse the Disciplinary Oversight Committee for appropriate administrative costs and actual expenses incurred in the prosecution of the matter.

“It is ORDERED that Meryl M. Polcari of Old Bridge is hereby reprimanded.

According to avvo.com, Ms. Polcari is a real estate attorney in Old Bridge, New Jersey. She attended Seton Hall University. She acquired her law license in New Jersey in 1986.
