On Monday, July 31, 2023, the Supreme Court of Tennessee ordered the reinstatement of attorney Georgia B. Felner to the active practice of law following the completion of her three-year suspension. The suspension stemmed from her plea of nolo contendere to the sale and delivery of cannabis.
The case is entitled “In re: Georgia B. Felner,” case no. M2019-01108-SC-BAR-BP.
Felner, and another attorney, who both served as former assistant district attorneys in Franklin, were arrested on January 2018 and accused of engaging in drug dealing activities. Subsequently, Felner entered a plea of nolo contendere to the sale and delivery of THC, a Schedule VI controlled substance, and was placed on two years of supervised probation starting from October 10, 2018.
Based on Felner’s conviction, the Court entered an Order of Enforcement on June 28, 2019, suspending Felner from the practice of law for three (3) years. She was required to serve a minimum of 18 months served on active suspension and the remainder of probation with conditions including her obligation to contact the Tennessee Lawyer’s Assistance Program (TLAP) within 30 days of the Order of Enforcement for assessment and compliance with any recommended monitoring agreement. She was ordered to comply with the terms of her probation, pay all assessed costs within 90 days of the Order of Enforcement, and avoid any new complaints of misconduct during the probation period that may result in disciplinary action recommended by the Board.
On January 31, 2023, Felner filed a petition for reinstatement, which was deemed satisfactory by the Hearing Panel.
Considering the facts presented and the Findings of Fact and Conclusions of Law by the Hearing Panel, the Court ruled in favor of Felner’s petition and reinstated her to the active practice of law in Tennessee.
