On Thursday, January 5, 2023, the U.S. Department of Justice Executive Office for Immigration Review Board of Immigration Appeals filed an Opinion indefinitely suspending attorney Mark Wilfred Ciaravella from the practice before the Board of Immigration Appeals, the Immigration Courts, and DHS.

The case is entitled “In the matter of Mark Wilfred Ciaravella” with case no. D2022-0196.

The United States Court of Appeals for the Eleventh Circuit indefinitely suspended the respondent from practice before the court on October 14, 2022. After such suspension, the Disciplinary Counsel for the Executive Office for Immigration Review and the Disciplinary Counsel for the Department of Homeland Security jointly petitioned for the respondent’s immediate suspension from practice before the Board of Immigration Appeals, the Immigration Courts, and DHS. This has been granted on December 7, 2022.

The respondent was required then to file a timely answer to the allegations on the said Joint Notice of Intent to Discipline. However, the respondent failed to do so. For this failure, the respondent has been precluded from requesting a hearing on the said matter.

According to the Court, the proposed sanction in the Joint Notice of Intent to Discipline is appropriate in light of the respondent’s indefinite suspension before the Eleventh Circuit. Considering all of the facts and prior suspensions in the case, the Board decided to suspend the respondent from practice before the Board of Immigration Appeals, the Immigration Courts, and DHS.
