On Monday, October 31, 2022, the Supreme Court of Tennessee ruled on the petition to transfer to disability inactive status Knox County attorney Stephen Wayne Gibson for being currently incapacitated from continuing the practice of law per documentation from Gibson and his medical provider.
The case, titled In Re: Stephen Wayne Gibson, was brought by The Board of Professional Responsibility of the Supreme Court of Tennessee. Case #M2022-01520-SC-BAR-BP.
According to the filing:
“By Order of the Tennessee Supreme Court entered October 31, 2022, the law license of Stephen Wayne Gibson was transferred to disability inactive status pursuant to Section 27.3 of Tennessee Supreme Court Rule 9. ”
The Court based upon due consideration of Gibson’s incapacity to continue his law practice granted the petition.
The Order Transferring Attorney to Disability Inactive Status reads:
“1. The law license of Stephen Wayne Gibson shall be transferred to liability inactive status for an indefinite period of time and until further order of the Supreme Court.
2. Mr. Gibson shall comply with Tenn. Sup. Ct. R. 9 in all respects and particularly as provided in Tenn. Sup. Ct. R. 9, § 28.
3. Mr. Gibson shall be allowed to petition for reinstatement to active status pursuant to Tenn. Sup. Ct. R. 9 § 27.7.
4. The Board shall publish notice of this transfer pursuant to Sup. Ct. R. 9, §§ 27.5 and 28.11.”
Accordingly, in compliance with the Court’s Order, the Board of Professional Responsibility published the information on the temporary suspension of Nero on the same day, October 31, 2022.
Mr. Gibson is not allowed to practice law while on disability inactive status. He may return to the practice of law upon proof that his disability has been removed in accordance of Supreme Court Rule 9, Section 27.7.
