The Supreme Court of Tennessee temporarily suspended Attorney James Daniel Marshall from practicing law on January 18, 2024.

The case is entitled “In the Matter of James Daniel Marshall.”

According to a press release from the Board of Professional Responsibility, Mr. Marshall was facing a misconduct complaint and failed to respond to inquiries from the Board regarding the allegations.

Section 12.3 of Supreme Court Rule 9 allows for the immediate temporary suspension of an attorney’s license if they do not respond to a misconduct complaint. As a result, Mr. Marshall must cease taking on new clients and representing existing clients by February 17, 2024. After that date, he is prohibited from using any indication that he is a lawyer, legal assistant, or law clerk and cannot conduct law practice from any location.

The suspension order requires Mr. Marshall to inform all current clients about the status of their cases and provide any client papers or property. He must comply with Tennessee Supreme Court Rule 9 regarding the duties of suspended attorneys and the process for seeking reinstatement. The temporary suspension will remain in place until dissolved or modified by the Supreme Court.

According to the Tennessee Board of Professional Responsibility, Mr. Marshall attended the Stetson University – College of Law. He acquired his law license in Tennessee in 2007.
