On Friday, October 7, 2022, the Supreme Court of Tennessee ruled on the Petition for Temporary Suspension of Nashville attorney Dana L. Nero filed by the Board of Professional Responsibility relating to charges for attorney discipline for failure to respond to Disciplinary Counsel concerning a complaint of misconduct.

The case, titled In Re: Dana L. Nero, was brought by The Board of Professional Responsibility of the Supreme Court of Tennessee. Case #M2022-01412-SC-BAR-BP.

According to the filing:

“On October 7, 2022, the Supreme Court of Tennessee temporarily suspended Dana L. Nero from the practice of law upon finding that Ms. Nero failed to respond to Disciplinary Counsel concerning a complaint of misconduct. Section 12.3(a) of Supreme Court Rule 9 provides for the immediate summary suspension of an attorney’s license to practice law in cases where an attorney fails to respond to Disciplinary Counsel concerning a complaint of misconduct.”

The Court based upon the Petition and the supporting Affidavit finds that Dana L. Nero, Respondent, has failed to respond to Disciplinary Counsel concerning a complaint of misconduct.

The Order of Temporary Suspension reads:

“1. Dana L. Nero is hereby temporarily suspended from the practice of law as provided in Tenn. Sup. Ct. R. 9, § 12.3.

2. Dana L. Nero shall comply with Tenn. Sup. Ct. R. 9 in all respects and particularly as provided in Tenn. Sup. Ct. R. 9, § 28.

3. Dana L. Nero may make application for dissolution or modification of this Order as provided in Tenn. Sup. Ct. R. 9, § 12.3.

4. The Board of Professional Responsibility shall cause notice of this suspension of Dana L. Nero to be published as required by Tenn. Sup. Ct. R. 9, § 28.11.”

Accordingly, in compliance with the Court’s Order, the Board of Professional Responsibility published the information on the temporary suspension of Nero on the same day, October 7, 2022.

Starting November 6, 2022, Ms. Nero is immediately precluded from accepting any new cases and must cease representing clients. She shall not use any indicia of a lawyer, legal assistant, or law clerk, nor maintain a presence wherein the practice of law is conducted after November 6, 2022.
