On Monday, February 13, 2023, the Supreme Court of Tennessee ruled on the petition to transfer to disability inactive status Columbia attorney James Thomas DuBois, Jr. for being currently incapacitated from continuing the practice of law per documentation from Dubois, Jr. and his medical provider.
The case, titled In Re: James Thomas DuBois, Jr., was brought by The Board of Professional Responsibility of the Supreme Court of Tennessee. Case #M2023-00194-SC-BAR-BP.
According to the filing:
“By Order of the Tennessee Supreme Court entered February 13, 2023, the law license of James Thomas DuBois, Jr. was transferred to disability inactive status pursuant to Section 27.4 of Tennessee Supreme Court Rule 9. ”
The Court based upon due consideration of Respondent’s incapacity to continue his law practice entered an Order granting the petition and transferring Respondent’s law license to disability inactive status.
The Order Transferring Attorney to Disability Inactive Status reads:
“1. The law license of James Thomas DuBois, Jr. shall be transferred to liability inactive status for an indefinite period of time and until further order of the Supreme Court.
2. Mr. DuBois shall comply with Tenn. Sup. Ct. R. 9 in all respects and particularly as provided in Tenn. Sup. Ct. R. 9, § 28.
3. Mr. DuBois shall be allowed to petition for reinstatement to active status pursuant to Tenn. Sup. Ct. R. 9 § 27.7.
4. The Board shall publish notice of this transfer pursuant to Sup. Ct. R. 9, §§ 27.5 and 28.11.”
Accordingly, in compliance with the Court’s Order, the Board of Professional Responsibility published the information of the Respondent’s transfer to disability inactive status on the same day, February 13, 2023.
Mr. DuBois is not allowed to practice law while on disability inactive status. He may return to the practice of law upon proof that his disability has been removed in accordance with Supreme Court Rule 9, Section 27.7.
Mr. DuBois, Jr. attended the University of Tennessee – College of Law. He had practiced in Columbia, Tennessee. He had been licensed in Tennessee, license #013777. His info can be found on the Board of Professional Responsibility of the Supreme Court of Tennessee’s website.
