On Thursday, March 9, 2023, the State of New York, Supreme Court, Appellate Division, Third Judicial Department, in a memorandum and order on motion accepted attorney Jonathan Fenron Burke’s application for permission to resign for non-disciplinary reasons.
The case is entitled “In the Matter of Jonathan Fenron Burke,” with case no. PM-49-23.
On October 11, 2022, the petitioner, through a sworn affidavit, requested to leave and resign from the New York Bar for non-disciplinary reasons. The Attorney Grievance Committee (ACG) for the Third Judicial Department, upon consideration, stated that it doesn’t oppose the request of Mr. Burke to resign.
In consideration of the advice of the ACG wherein it declared the eligibility of Mr. Burke to resign for non-disciplinary reasons, and the sworn affidavit filed by the latter, the court granted the said application.
The petitioner was removed from New York’s list of attorneys. Moreover, the petitioner was mandated to desist and refrain from the practice of law in any form in the State of New York, whether as an agent, principal, employee, or clerk. He is forbidden to appear as an attorney or counselor at law before any judge, court, justice, board, commission, or public authority.
Mr. Burke is also ordered, within 30 days from the date of the decision, to surrender to the Office of Court Administration any secure pass for an attorney that has been issued to him.
The order states:
“ORDERED that Jonathan Fenton Burke’s application for permission to resign is granted and his nondisciplinary resignation is accepted”
