On November 28, 2023, the Virginia State Bar Disciplinary Board suspended attorney Matt Clay Pinsker for one year following a guilty verdict in a sex crime case.
The case is entitled “In the Matter of Matt Clay Pinsker” with case number 21-033-122719.
According to WTVR News, Pinsker was indicted in May 2021 on three felony charges, including rape, after a Virginia Commonwealth University (VCU) student accused him of sexual assault. It revealed that the alleged victim initially interned for Pinsker and was later hired to work for him. On February 5, 2021, the two reportedly consumed wine and liquor together. The following morning, the intern claimed to wake up alone on the floor of Pinsker’s new law office. Pinsker later informed her that they had engaged in sexual interactions, though he believed they had not had intercourse.
Concerned about the events, the woman sought a rape kit at VCU Medical Center. Subsequently, Pinsker admitted to having consensual sex with the intern but asserted that both parties were intoxicated. The case was scheduled for trial, but Pinsker entered an Alford plea in June 2022, admitting to a reduced charge of misdemeanor sexual battery.
During sentencing, the court concurred with the prosecution’s assertion that Pinsker had been grooming interns. Pinsker received a 12-month jail term. The State Bar documents allege professional misconduct, citing Pinsker’s deliberate wrongful act reflecting adversely on his honesty, trustworthiness, or fitness to practice law.
In Pinsker’s plea agreement, it is stated that the sexual battery was accomplished by force, threats, or intimidation, not physical helplessness or incapacity. Virginia State Bar’s Disciplinary Board ruled that Pinsker did engage in professional misconduct, suspending his license.
According to Avvo, Mr. Pinsker is a criminal defense attorney in Glen Allen, Virginia. He graduated from West Virginia University College of Law in 2012 and obtained his law license in Virginia in the same year.
