On Tuesday, August 21, 2023, the Virginia State Bar’s Eighth District Subcommittee issued a public reprimand without terms against attorney Patrick Michael McGraw. This disciplinary action comes in response to two separate complaints filed against McGraw, highlighting issues related to communication, diligence, and handling of client funds.
The case is entitled “In the Matter of Patrick Michael McGraw” with case nos. 22-080-124934 and 22-080-126082.
The charge cited the Rules of Professional Conduct rules 1.3, 1.4, 1.5, 1.15, and 8.4.
The first case stemmed when Dr. McKain sought McGraw’s legal assistance in modifying spousal support due to changes in his financial circumstances. Despite receiving payment and representing Dr. McKain, McGraw failed to adequately communicate with his client, did not clarify the nature of the initial payment received, and neglected to respond to legal motions promptly. This lack of diligence and communication led to Dr. McKain terminating McGraw’s services.
Alicia Terry, the complainant in the second case, engaged McGraw to collect outstanding child support from her son’s father. Similar to the first case, McGraw’s actions raised concerns about his diligence and truthfulness in representing his client. Ms. Terry’s complaint highlighted McGraw’s false statements about filing court documents on her behalf, ultimately resulting in her termination of his services.
As a result of the abovementioned violations, the Eighth District Subcommittee issued a public reprimand without terms to Patrick Michael McGraw.
The order reads:
“Accordingly, having approved the agreed disposition, it is the decision of the Subcommittee to impose a public reprimand without terms, and Patrick Michael McGraw is hereby so reprimanded.”
