On Thursday, June 8, 2023, the State of New York Supreme Court, Appellate DivisionThird Judicial Department granted the application for permission to resign for non-disciplinary reasons of attorney Rachel S. Janger.

The case is entitled “Attorney Grievance Committee for the Third Judicial Department v. Rachel S. Janger ” with case no. PM-123-23

Rachel S. Janger, an attorney admitted to practice by the Court in 1999, has submitted an application to resign from the New York Bar for non-disciplinary reasons. Janger’s request, supported by an affidavit sworn on March 27, 2023, seeks permission to resign according to the Rules for Attorney Disciplinary Matters [22 NYCRR] § 1240.22 [a].

However, the Attorney Grievance Committee for the Third Judicial Department (AGC) has opposed the application, arguing that Janger is ineligible for non-disciplinary resignation due to her failure to meet the attorney registration requirements for the most recent biennial period, as outlined in Judiciary Law § 468-a and previous court cases. In response to the AGC’s opposition, Janger has submitted a supplemental affidavit, sworn to on May 26, 2023, asserting that she has now fulfilled her New York attorney registration requirements.

The Office of Court Administration records has confirmed Janger’s updated registration status and resolved any previous delinquency. With no substantive objections from the AGC and considering Janger’s current eligibility for nondisciplinary resignation, the court granted her application and accepted her resignation. Consequently, Rachel S. Janger’s name will be struck from the roll of attorneys and counselors-at-law of the State of New York, effective immediately, unless otherwise ordered by the court. As per the court’s decision, Janger is prohibited from practicing law in any capacity in the state, appearing as an attorney before any legal authority, providing legal opinions or advice, or holding herself out as an attorney and counselor-at-law in New York. Furthermore, Janger is required to surrender any attorney secure pass issued to her within 30 days of the decision.

The Disposition states:

“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
