On Thursday, November 17, 2022, the Supreme Court of Appeals of the State of West Virginia ruled on Joyce Elaine Nailing’s petition seeking to voluntarily resign as a member of the West Virginia State Bar.

The case is styled In re Petition for Voluntary Resignation from the West Virginia State Bar of Joyce Elaine Nailing, case #22-648.

Hill filed her petition on August 19, 2022, in accordance with Rule 3.26(a) of the  Rules of Lawyer Disciplinary Procedure. The Investigative Panel of the Lawyer Disciplinary Board recommended to the Court to accept Nailing’s petition for voluntary resignation.

Accordingly, the Appeals Court granted Nailing’s petition.

The disposition reads:

“It is ORDERED that the petitioner, Joyce Elaine Nailing, has leave to voluntarily resign from the West Virginia State Bar. It is finally ordered that the petitioner shall comply with the client notification requirements of Rule 3.28 of the Rules of Lawyer Disciplinary Procedure, if applicable.”

Ms. Nailing had been admitted to practice in West Virginia.
