Should she seek to resume active status, Tuchman will face a two-year probation period with specific conditions. Within 10 days of notifying the State Bar of her intent to return to practice, she must contact the Compliance Monitor to schedule an assessment, unless waived by sufficient counselor-provided information. The Compliance Monitor will establish probation terms, including reporting requirements, with Tuchman responsible for associated costs. She is also required to commit no further violations of professional conduct rules.
The agreement referenced the American Bar Association’s Standards for Imposing Lawyer Sanctions, noting that suspension is typically warranted for such misconduct but was reduced to a reprimand due to mitigating factors. These include Tuchman’s lack of prior disciplinary history, absence of dishonest motives, and personal or emotional challenges. Aggravating factors included multiple offenses and her substantial experience as a lawyer. The complainant was notified and raised no objections to the agreement.
