On Thursday, May 30, 2024, the New York State Supreme Court, Appellate Division, Third Judicial Department accepted attorney Nancy Carol Smith’s request to resign from the New York State Bar for nondisciplinary reasons.

The case is entitled “In the Matter of Nancy Carol Smith” with case number PM-11-24.

Smith was admitted to practice law in New York in 2020 and currently lists her business address in Los Angeles, California. She applied to resign under rules that allow attorneys to voluntarily leave the bar without facing disciplinary action.

The Attorney Grievance Committee for the Third Judicial Department, which oversees attorney conduct in the region, advised the court that it did not oppose Smith’s application. In making its decision, the court reviewed Smith’s affidavit, stating her reasons for leaving, as well as correspondence from the Deputy Chief Attorney of the Grievance Committee.

In a unanimous ruling, the five justices of the Appellate Court accepted Smith’s resignation, removed her name from the roll of New York attorneys, and revoked her eligibility to practice law in New York state. The order prohibits Smith from practicing or representing herself as an attorney in New York moving forward. Additionally, she must return any Attorney Secure Pass issued to her for remote access to digital court records within 30 days.

According to Avvo, Ms. Smith is a real estate attorney in Los Angeles, California. She graduated from the Yale Law School in 1981.
