On Thursday, October 24, 2024, the New York Supreme Court, Appellate Division, Third Judicial Department denied attorney Jonathan Wayne’s application to resign from the New York State Bar for nondisciplinary reasons.
The case is entitled “In the Matter of Jonathan Wayne,” with case no. PM-208-24.
Wayne had sought to leave the New York Bar voluntarily. However, the Attorney Grievance Committee for the Third Judicial Department opposed it due to his current delinquency in meeting New York’s attorney registration requirements. Records indicate Wayne failed to complete his registration for the biennial period beginning in 2023.
The court noted that non-compliance can result in potential disciplinary action for professional misconduct. As Wayne remained delinquent on his registration at the time of his resignation request, he was ineligible to resign from the bar in a nondisciplinary manner.
In denying the application, the five-justice panel comprised affirmed the position of the Attorney Grievance Committee. The order makes clear any future effort by Wayne to leave the New York bar would need to include proof he is current on all registration requirements under the Judiciary Law and court rules relating to attorney obligations.
The Disposition states:
“ORDERED that Jonathan Wayne’s application for permission to resign is denied.”
According to the filing, Mr. Wayne acquired his law license in New York in 1997.
