On Tuesday, January 13, 2026, the Virginia State Bar Disciplinary Board suspended attorney Brian Victor Lee for 30 days following an agreed disposition memorandum order. The decision, which was made virtually, comes after a reciprocal matter pending before the Board, related to disciplinary actions in the District of Columbia.
The case is entitled “In the Matter of Brian Victor Lee,” with case number 26-000-137817.
According to documents, the disciplinary actions stem from a case where Lee represented Kevin L. Whited in a foreclosure action beginning in May 2017. Disciplinary Counsel for the District of Columbia Bar filed a Petition for Negotiated Discipline on September 3, 2024, citing violations of the District of Columbia Rules of Professional Conduct.
Specifically, Lee and the Office of Disciplinary Counsel stipulated that Lee failed to appear for six of at least fourteen scheduled appearances in D.C. Superior Court in Whited’s matter. Whited stated that he was not informed about the hearings, nor did Lee consult with him about his decision not to attend, or direct Whited to appear on his own.
In January 2018, the Superior Court entered a default against Whited after Lee failed to appear for another status hearing. Whited subsequently lost legal possession of his house. Lee chose not to attend the hearings because he believed Whited had no path forward and was only “buying time.”
Whited discharged Lee in November 2022, and Lee moved to withdraw from the case in December 2022. The presiding judge granted Lee’s motion in January 2023, with both Lee and Whited present. However, Lee had not explained to Whited that he was required to file a motion to be released from the case and that the discharge would not be effective until the judge granted the motion.
The Virginia State Bar Disciplinary Board panel consisted of Adam M. Carroll, Second Vice Chair; Dawn E. Boyce; Donita M. King; David R. Tiller; and Elisabeth Martingayle, Lay Member. Jessica C. Beatty, Assistant Bar Counsel, represented the Virginia State Bar, while Justin Michael Flint served as counsel for Lee.
The order stipulates that the suspension is effective as of January 13, 2026. Lee must comply with Part Six, Section IV, Paragraph 13-29 of the Rules of the Supreme Court of Virginia, which includes notifying clients, opposing attorneys, and presiding judges of his suspension. He must also make arrangements for the disposition of matters in his care. Lee is required to provide proof of these notifications to the Clerk of the Disciplinary System of the Virginia State Bar within sixty days.
