On Thursday, October 23, 2025, the New York Supreme Court, Appellate Division, Third Judicial Department granted the Attorney Grievance Committee’s motion to disbar Darlene Debra Brown, a suspended attorney.
The case is entitled “In the Matter of Darlene Debra Brown,” with case number PM-236-25.
Brown faced disciplinary action following a client complaint in January 2024. The complaint alleged neglect in an immigration matter, leading to an Order of Removal against the client. The Attorney Grievance Committee (AGC) initiated an investigation, during which Brown initially requested an extension to respond to the notice of complaint. However, she subsequently failed to respond or appear for an examination under oath.
As a result, in November 2024, the court suspended Brown’s license to practice law pending the AGC’s ongoing investigation. The current motion for disbarment was filed after Brown’s continued failure to respond or participate in disciplinary proceedings within six months of the suspension order.
The court’s decision to disbar Brown was based on Rules for Attorney Disciplinary Matters (22 NYCRR) § 1240.9 (b), which allows for disbarment without further notice if a suspended attorney fails to cooperate within six months. The AGC demonstrated that Brown was served the suspension order via first-class mail to her business and home addresses, as well as by email, all addresses listed with the Office of Court Administration. The AGC also alerted Brown to the potential disbarment if she failed to respond.
The court noted that Brown did not respond to the disbarment motion, indicating a lack of interest in her status as an attorney in New York. Citing the need to protect the public interest under Rules for Attorney Disciplinary Matters [22 NYCRR] § 1240.9 [a], the court granted the AGC’s motion.
The order mandates that Brown’s name be removed from the roll of attorneys and counselors-at-law in New York State, effective immediately. She is prohibited from practicing law in any capacity within the state, including offering legal advice or representing herself as an attorney. Brown must also comply with the Rules for Attorney Disciplinary Matters regarding the conduct of disbarred attorneys, including certifying her compliance.
