On Tuesday, March 12, 2024, the Board of Immigration Appeals reinstated attorney Donald P. Vernon to practice before immigration courts and the Board of Immigration Appeals.

The case is entitled “In the Matter of Donald P. Vernon.”

Vernon had previously been suspended from practice for 6 months effective September 6, 2021, due to a suspension imposed by the Appellate Division of the Supreme Court of New York. In its November 10, 2021 order, the Board suspended Vernon to mirror the state disciplinary action.

Vernon filed two motions for reinstatement. The first was denied on December 22, 2023, and an additional 30-day suspension was imposed for Vernon’s failure to comply with the initial suspension order. In his second motion, Vernon provided evidence that he had been reinstated to practice law in New York and argued he met the regulatory definition to practice before the immigration agencies.

Neither the Disciplinary Counsel for the Executive Office for Immigration Review nor the Disciplinary Counsel for the Department of Homeland Security opposed Vernon’s second reinstatement motion. Considering Vernon had been reinstated in New York and complied with all suspension orders, the Board granted the motion. The March 12, 2024 order reinstates Vernon’s ability to practice before immigration courts and the Board, effective immediately.

The Disposition states:

“The respondent is reinstated to practice before the Board of Immigration Appeals, the Immigration Courts, and DHS. as of the date of this order.”

According to avvo.com, Mr. Vernon is a probate attorney in Jamaica, New York. He attended the New York Law Schoo. He acquired his law license in New York in 1996.
