On Monday, June 30, 2025, the Massachusetts Board of Bar Overseers of the Supreme Judicial Court publicly reprimanded Attorney Kaleb Pan for professional misconduct involving negligent misuse of client funds and inadequate record-keeping.
The case is entitled “Bar Counsel v. Kaleb Pan, Esq.,” with case no. 2025-6.
The decision followed a stipulation between Pan and Bar Counsel, accepted by the Board on May 12, 2025.
The issues arose from Pan’s mishandling of Interest on Lawyers Trust Accounts (IOLTA). In February 2022, after an attempted fraud on one IOLTA account, Pan opened a new account but deposited real estate holdback funds into a rarely used third account due to unavailable checks. He failed to record these funds in a client ledger and neglected to maintain complete ledgers or bank fee records for both the third account (from December 2021 to June 2022) and the new account (from March 2022 to May 2023).
In January 2023, Pan issued a check from the wrong account, causing a negligent misuse of client funds, unnoticed until May 2023, when another client’s check was returned for insufficient funds.
Additionally, Pan opened a fourth IOLTA account for real estate conveyancing but used an electronic recording service linked to the account that the respondent had opened in February 2022. This led to fees being withdrawn from the wrong account, resulting in another instance of negligent fund misuse. These actions violated Massachusetts Rules of Professional Conduct related to safeguarding trust funds, disbursing unavailable funds, and maintaining proper account ledgers.
In 2018, Pan had entered a diversion agreement for similar record-keeping issues and attended a trust account class. To address the recent violations, he has since hired a bookkeeper, closed some IOLTA accounts, updated his records, and retaken the trust account class. No clients lost funds due to his actions.
The Board’s public reprimand reflects the agreed-upon sanction for Pan’s misconduct.
The Disposition states:
“Whereupon, pursuant to Supreme Judicial Court Rule 4:01, Section 8(3), and the Rules of the Board of Bar Overseers, Section 3.56, it is ORDERED AND ADJUDGED that Kaleb Pan be and hereby is PUBLICLY REPRIMANDED.”
According to Avvo.com, Mr. Pan is an intellectual property attorney in North Andover, Massachusetts. He attended the University of California at Los Angeles School of Law. He acquired his law license in Massachusetts in 2004.
