On Thursday, April 11, 2024, the Appellate Division of the Supreme Court of the State of New York, Third Department allowed Marcia A. Membrino to resign from the New York Bar.

The case is entitled “In the Matter of Marcia A. Membrino,” with case number PM-60-24.

Membrino had submitted an affidavit to the court on February 29th requesting to resign from the New York bar for nondisciplinary reasons. The Attorney Grievance Committee for the Third Judicial Department informed the court that they do not oppose Ms. Membrino’s application for resignation.

In a brief per curiam opinion, the Appellate Court accepted Ms. Membrino’s resignation from practice. She will be stricken from the roll of attorneys authorized to practice in New York state. As a result of her resignation, Ms. Membrino is now commanded by the court’s order to desist and refrain from engaging in the practice of law in any form in New York. She must also surrender any Attorney Secure Pass issued to her to the Office of Court Administration within 30 days. With her nondisciplinary resignation accepted, Ms. Membrino is no longer allowed to act or hold herself out as an attorney licensed in New York.

According to Avvo, Ms. Membrino is an attorney in Oneonta, New York. She attended the Seton Hall University School of Law. She obtained her law license in New York in 1984.
