On Thursday, February 9, 2023, the State of New York, Supreme Court, Appellate Division, Third Judicial Department, accepted attorney Marc Maher’s application for permission to resign for non-disciplinary reasons.
The case is entitled “In the matter of Marc Maher” with case no. PM-22-23.
On December 30, 2022, the petitioner, through a sworn affidavit, requested to leave and resign from the New York bar for non-disciplinary reasons. The Attorney Grievance Committee (ACG) for the third judicial department, upon consideration, stated that it doesn’t oppose the request of Mr. Maher.
In consideration of the advice of the ACG wherein it declared the eligibility of Mr. Maher to resign for non-disciplinary reasons, and the sworn affidavit filed by the latter, the court granted the said application.
The court ordered the petitioner to be stricken from the State of New York’s list of attorneys, Moreover, the petitioner was mandated to desist and refrain from the practice of law in any form in the State of New York, whether as an agent, principal, employee, or clerk. He is forbidden to appear as an attorney or counselor at law before any judge, court, justice, board, commission, or public authority. The petitioner must also refrain from giving his opinion on the law and application, or any advice in relation.
Mr. Maher is ordered as well, within 30 days from the date of the decision, to surrender to the Office of Court Administration any secure pass for an attorney that has been issued to him.
The Disposition states:
“ORDERED that Marc Maher’s application for permission to resign is granted and his nondisciplinary resignation is accepted.”
