On Monday, July 29, 2024, the Board of Immigration Appeals granted a petition to immediately suspend attorney Danielle Alexandra Phillips from practicing law before immigration courts and the Department of Homeland Security.
The case is entitled “In the Matter of Danielle Alexandra Phillips.”
The petition was jointly filed by the Disciplinary Counsel for the Executive Office for Immigration Review and the Disciplinary Counsel for DHS on July 22, 2024. It requested Phillips’ suspension based on her being permanently disbarred from practicing in the U.S. District Court for the District of New Mexico on February 27, 2024.
The panel of the BIA agreed that the disbarment constituted grounds for immediate suspension under the regulations. As a result, Phillips is now prohibited from representing clients in cases pending before the immigration courts, BIA, and DHS until the completion of disciplinary proceedings.
The order requires Phillips to promptly notify any clients with ongoing immigration cases of her suspension in writing. She must also keep records demonstrating her compliance. However, the BIA may set aside the suspension order if Phillips can establish good cause, such as if it is deemed to be in the interest of justice to permit her to continue practicing.
