On Tuesday, September 24, 2024, The Florida Bar filed a petition in the Supreme Court of Florida seeking an emergency suspension of lawyer Marc Evan Brown.
The case is entitled “The Florida Bar v. Marc Evan Brown,” with case number 2024-50,684(17C).
The Florida Bar alleges in the petition that Brown misappropriated over $40,000 in client funds and engaged in misrepresentation and deceptive acts related to a real estate escrow matter. An investigation was started after a client filed a grievance, claiming Brown said he filed an interpleader action when he had not.
According to the petition, auditors discovered Brown transferred money from his trust account into his operating account and then used the funds for personal benefit rather than the intended client matter. He also failed to properly maintain the required trust accounting records. The petition asserts Brown’s actions pose an immediate serious harm to clients and the public.
The Florida Bar is seeking an order from the Supreme Court immediately suspending Brown from practicing law. If granted, Brown would be prohibited from taking on new cases or accessing client funds while the disciplinary case against him moves forward. He would also be required to notify current clients and turn over any legal matters to replacement counsel within 30 days.
According to Avvo, Mr. Brown is a real estate attorney in Fort Lauderdale, Florida. He obtained his law license in Florida in 2006.
