On January 11, 2023, suspended Fargo Attorney Kristin A. Overboe filed her Declaration in compliance with the Supreme Court of the State of North Dakota Order of Interim Suspension dated December 15, 2022, ordering Overboe to comply with North Dakota Rules for Lawyer Discipline 6.3, Notice of Status.

The case is styled “In the Matter of Kristin A. Overboe,” case no. 20220352.

Overboe’s Interim Suspension on December 15, 2022, was pursuant to the Application for Interim Suspension filed by the Office of Disciplinary Counsel stating that there are grounds to believe that Overboe has been experiencing a gradual, yet consistent degeneration of her mental health to the extent that the Office of Disciplinary Counsel believes that Overboe can no longer competently represent her clients and poses an imminent threat to her client’s interest and to any potential future clients. Moreover, a petition for discipline was filed against Overboe alleging a lack of competence in her representation of a client in a family law matter by her failure to comply with discovery and coming to court unprepared for trial. The petition further alleges that Overboe failed to communicate with the client and failed to provide the client’s file.

The Court ordered the immediate suspension of Overboe’s license to practice law until further order from the court and ordered Overboe to comply with N.D.R. Lawyer Discipl. 6.3, Notice of Status.

In compliance with the Order of the Court, Overboe submitted to the Court her Declaration which stated, among others, that she caused notice of her interim suspension to all her clients being represented in pending matters, as well as to the opposing counsel in pending matters, that she has delivered to said clients any papers or other property to which they are entitled, that she has refunded fees paid in advance that have not been earned, and also some fees that have been earned.

Ms. Overboe practiced in Fargo, North Dakota prior to the suspension. She attended the Ohio Northern University Pettit College of Law and was admitted to practice in North Dakota in 2010. Her info can be found on the State of North Dakota Court’s website.
