On Tuesday, March 19, 2024, the Supreme Court of Florida issued an order granting The Florida Bar’s petition for contempt against Attorney Albert E. Moon and suspending him from the practice of law.

The case is entitled “The Florida Bar v. Albert E. Moon,” with case no. SC2023-1717.

The Court’s order stems from Mr. Moon’s failure to fully comply with a subpoena issued by the Florida Bar Grievance Committee related to a disciplinary investigation. In response to a client complaint filed by Dr. Robert Frankl alleging improper disbursement of funds from his trust account, the Bar subpoenaed records from Mr. Moon’s trust between August 2019 to July 2022.

While Mr. Moon was granted several extensions, he only provided partial records according to the Bar’s petition. On November 30, 2023, the Eleventh Judicial Circuit Grievance Committee found Mr. Moon did not establish good cause for his non-compliance and deemed his actions willful contempt. Based on these findings, the Bar filed its petition for contempt with the Supreme Court on December 12, 2023.

In its Order, the Supreme Court granted the Bar’s petition and held Mr. Moon in contempt. As a sanction, he has been suspended from practicing law effective 30 days to allow him time to close out his practice and protect existing clients. Mr. Moon will remain suspended until he fully complies with the subpoena by producing all requested documents.

If Mr. Moon notifies the Court he is no longer practicing before the 30 days, the suspension will take effect immediately. In addition to complying with rules governing suspended attorneys, Mr. Moon must also accept no new clients. He will remain suspended until the Court issues a reinstatement order. The Supreme Court also entered judgment against Mr. Moon, ordering him to pay $1,250 in costs to the Bar.
