On Monday, May 15, 2023, the Florida Bar filed a petition for contempt and order to show cause against attorney Frank T. Noska before the Supreme Court of Florida. The case is entitled “The Florida Bar v. Frank T. Noska.”

On April 26, 2023, the 15th Judicial Circuit Grievance Committee deliberated whether to declare the respondent non-compliant for his failure to respond to an official inquiry. Supposedly, a letter notifying the respondent of a complaint in the case was sent via regular U.S. Mail to his registered address on January 27, 2023, with a request to respond by February 13, 2023. Regrettably, the respondent neglected to submit a response.

The filing states:

“On February 16, 2023, the bar counsel’s secretary, Sheri Miles, called the telephone number that the respondent has listed with The Florida Bar and left a voicemail message to return the call. The respondent’s record bar telephone number has a voicemail with no name recorded. Respondent failed to return The Florida Bar’s telephone call. On February 16, 2023, the respondent was sent via email to the respondent’s record bar email address, [email protected], advising of a complaint in this case and was requested to respond in ten days to the letter.”

The filing continues:

“On March 22, 2023, the bar sent the respondent an Amended Request for Issuance of Notice of Non-Compliance and Finding of Contempt to correct a scrivener’s error which reflected a possible additional email address of respondent’s as [email protected] rather than a possible email address of [email protected], which was utilized by the bar in its communications. A copy of the amended request is attached hereto as a part of “The Florida Bar’s Composite Exhibit B”. 14. On April 24, 2023, the bar received the certified mail Request for Issuance of Non-Compliance sent to the respondent at 100 Edgelawn Road, Asheville, NC 28804 on March 21, 2023, marked “Refused” from the U.S. Postal Service.”

As of date, the respondent hasn’t responded yet to the official bar inquiry. In lieu of this, the Florida Bar requested the court to suspend the respondent until the same response in writing to the official bar inquiry.

The Petition for Contempt and Order to show cause states:

“WHEREFORE, The Florida Bar requests that this Court suspend respondent pursuant to Rule 3-7.11(f), until such time as respondent fully responds in writing to the official Bar inquiry contained in “Exhibit I” and until further order of this Court.”
